Agreement to These Terms
By accessing or using www.elranchoeventcenter.com (the “Site”), operated by El Rancho Event Center (“El Rancho,” “we,” “us,” or “our”), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.
Event Bookings Require a Signed Agreement
Information on the Site, including descriptions, photos, capacities, amenities, and availability, is general information. It is not an offer, reservation, or contract. Sending an inquiry does not reserve a date or space.
A booking is confirmed only when you and El Rancho sign a written event or rental agreement and any required deposit has been received. That agreement sets out pricing, payment, cancellation, capacity, insurance, and conduct terms, and it controls over anything on the Site.
Accuracy of Information
We work to keep the Site accurate and current, but details can change and errors can occur. Photos may show past events with décor, furniture, lighting, or setups provided by clients or vendors that are not included with a standard rental.
Guest capacities are approximate and depend on the room layout, event setup, and applicable fire and building codes. Please confirm any detail that is important to you with our team before booking.
Using the Site
You may use the Site to learn about our venue and plan events. You agree not to:
- Use the Site for any unlawful purpose or in a way that violates the rights of others.
- Attempt to gain unauthorized access to, disrupt, or overload the Site or the systems that run it.
- Use bots, scrapers, or other automated tools to collect content or data from the Site.
- Send false, misleading, harassing, or unsolicited commercial messages through our forms.
- Submit another person’s personal information without their permission.
Our Content
The Site and its content, including text, photographs, graphics, logos, and design, belong to El Rancho or its licensors and are protected by copyright, trademark, and other laws. You may view the Site and share links to it, but you may not copy, reproduce, modify, or distribute its content for commercial purposes without our written permission.
Copyright and Photo Removal Requests
We respect the rights and privacy of others. If you believe content on the Site infringes your copyright, or you appear in a photo and would like it removed, please contact us with a description of the content and where it appears on the Site. We will review your request promptly and remove content where appropriate.
Third-Party Links and Services
The Site links to or embeds services run by other companies, such as Google Maps, Instagram, Facebook, and WhatsApp. We do not control them and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.
Disclaimer
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, El Rancho and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Site. Our total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars (US $100).
Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you. This section does not limit any liability that cannot be limited by law, and it does not apply to a signed event agreement, which contains its own terms.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless El Rancho and its owners, employees, and agents from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these terms.
Governing Law and Disputes
These terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Before filing a claim related to the Site, you agree to contact us and try in good faith to resolve the dispute informally for at least 30 days.
Any dispute that is not resolved informally will be brought exclusively in the state courts located in Adams County, Washington, or the United States District Court for the Eastern District of Washington, and you consent to the jurisdiction of those courts.
Accessibility
We are committed to making the Site accessible to everyone. Please see our Accessibility Statement for details and for how to request assistance.
Changes to These Terms
We may update these terms by posting a revised version on this page with a new “Last updated” date. Changes apply from that date, and your continued use of the Site means you accept them.
General
If any part of these terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these terms is not a waiver of our right to do so later. These terms, together with our Privacy Policy, are the entire agreement between you and El Rancho about the Site.
These terms are available in English and Spanish. If the two versions conflict, the English version controls to the extent permitted by law.
